    14.  There is a booklet being prepared on Correctional Officers Rights, primarily for our Local No. 105. Until Then, some basic points:

    A. When ordered to write a report that you feel may put you in jeopardy, do not refuse to submit it. You should immediately contact your Local Representative, so he can review the individual set of circumstances with the attorney to decide if a Criminal Charge is likely. This procedure is to be followed in all matters out of which may arise job dismissal or the filing of criminal charges. Only minor disciplinary infractions will continue to be handled in the usual manner to the Contract and applicable Civil Service Rules and Regulations. In these latter cases, a report strictly limited to job performance must, under the law, be submitted.

  B. Never refuse a Direct Order. If possible, state Your position, ask for it in writing, or have a witness And grieve it as soon as possible.

    C. When giving a reasonable excuse make sure it is Sensible, sound and most of all, that it can be upheld.

    D. If you are sick, you don’t have to be in your residence. (Can be anywhere)

    E. When going into a hearing, even informal, you have the right to have a witness.

    F. Personal Property Damage, there is no limit on the claim. (Save the damaged items)

     G. When writing a serious report, you have the right to do so in a quiet area with help if you feel that it is needed.

     H. When in doubt, you have the right to see any and all written orders concerning your working condition or problem. Also Industrial Standards. (This should give a clear picture of who is right).

   I. Members who volunteer for non-paying duty, such as Escorted Furloughs, Community Activities, Shopping, Graduation, etc., will not have the backing of the Local or be entitled to legal help (You are on your own).

   J. There are many more issues that will be dealt with in the Officer's Rights Booklet.

P.B.A. Local No. 105 is by far one of the best run and organized Locals of the 50 State Locals. Recently we have made contact with surrounding State Correctional Organizations, they are not close to Local No. 105 in anything. They lack everything we take for granted.

   15. The 1975 State P.B.A. Convention will be held in Atlantic City, N.J. on Sept 18, 1975.

   16. There are now State P.B.A. By Laws for locals by which we are bound. It should smooth out all the problems of the past.

   17. A. State P.B.A. Life Insurance Program is frozen temporarily by our own Local due to the problems of the past.

   17. B. State P.B.A. Dental Program has the same problem, but on the State Level.

   18. For Unity and Strength all members should give the respect due to the Local Officers and Institutional Representatives. They were elected by the members as leaders to represent them. Let's not put them down to others. They are doing the best they can, if you feel different, so something through the proper procedures. Members must realize that you cannot give personnel or institutional problems away, just by informing someone. The Local can primarily only do what it can legally with the support of all its members.

JOE BARANYI, President
